Equitable Distribution (Property Division) is the term for the division of the marital property between spouses in a dissolution case. Martial property is all property accumulated during the marriage, including real estate, bank accounts, retirement plans, and personal property, as well as all liabilities or debts. In Florida, courts start with the premise that all marital property should be divided as equally as possible, but the courts also consider a variety of other factors to determine if a different division is equitable. Beth M. Terry will counsel you regarding each type of marital property or liability in your case based on her years of experience in litigating property division in Northeast Florida courts.
