Qualified Domestic Relations Orders (QDROs)

A Qualified Domestic Relations Order (QDRO) is an order, decree, or judgment that satisfies the criteria set out in Section 414 of the Internal Revenue Code for the payment of all or part of individual pension, profit sharing, or other retirement benefits to a spouse in a dissolution case. A QDRO is required by most retirement plan administrators before a transfer or payment of benefits is made although the final judgment or divorce decree provides for such payment.

Beth M. Terry is well-versed in all types of QDRO's, including military retirement benefits, civil service pensions, railroad retirement pensions, state and city pensions, as well as private pension plans, 401(k), profit-sharing and similar type retirement plans, and Individual Retirement Accounts (IRA's). We will advise you of all factors to consider regarding the division of retirement plans, and will provide a stream-lined process to enter and implement the necessary QDRO's in your case.
